Forensic Linguistics attempts to describe and, where possible, explain the features that distinguish the language used in legal settings from the everyday language. Furthermore, discourse analysis is capable of application in a wide variety of settings and contexts. The purpose of this paper is to outline the theory and practice of forensic discourse analysis as a tool for interpretation and analysis of legal context with a particular focus on legal pragmatics in Persian legal events to enable both researchers in legal system and forensic linguists to pass the level of theory and barge into the practice of discourse analysis in Persian legal system. In this regard, we focused on the Legal Speech Acts based on the theory of Searle J. (1969). A collection of 20 files issued in legal context were analyzed and the results and applications will be discussed. بررسی و تحلیل نقش نظریه های کاربردشناسی در بافت حقوقی، موضوعی جدید است. این پژوهش در بستری زبان شناختی و با تکیه بر نظریه «کارگفت» جان آر. سرل (1975) به بررسی نقش کارگفت در بافت حقوقی پرداخته است. به همین منظور، متن بیست دادنامه حقوقی صادره از یکی از شعب دیوان عالی کشور به عنوان پیکره انتخاب و از منظر نظریه کارگفت تحلیل شد. هدف اصلی این نوشتار را می­توان بررسی میزان تطبیق پذیری نظریه کارگفت با این متن حقوقی، کارکردهای ویژه نظریه کارگفت در این گونه حقوقی و تحلیل کاربردشناختی این رویداد حقوقی- گفتمانی در دو سطح خرد و کلان از منظر کنش منظوری (غیر بیانی) دانست. نتایج از تراکم بالای کارگفت در پیکره، اهمیت و تأثیر بسزای آن در بافت حقوقی و به ویژه این گونه حقوقی (دادنامه) حکایت می کند. از منظر رویداد گفتمانی و بر اساس برآیندهای مذکور، هر دادنامه حقوقی یک کنش کاربردی- اعلامی در سطح کلان گفتمان حقوقی به شمار می آید که تعداد زیادی کارگفت توصیفی و اعلامی و اندکی کارگفت های دیگر را شامل می شود. https://lrr.modares.ac.ir/article_6139_618faa1728eb2ef6e3733645273ab145.pdf
